CLEVELAND – Cuyahoga County Prosecutor Michael C. O’Malley announced that a Cuyahoga County grand jury has returned an indictment charging Donald Mynatt, 32, for the hit-and-run that killed Amir Prewitt in Cleveland.
“Amir Prewitt’s death is a terrible tragedy, and my thoughts and prayers remain with his family. Donald Mynatt selfishly thought he could evade justice, and thanks to the diligent work by the U.S. Marshals and the Cleveland Division of Police, that is not the case.”

On August 16, 2024, 7-year-old Amir Prewitt was riding his skateboard in the complex at the Lakeshore Beach Apartments in Cleveland. Mynatt was driving on the main access road in the complex when he struck Amir with his black Mercedes SUV. Mynatt then pulled into a parking area, turned around, and drove away at an accelerated rate of speed. Several bystanders called the police and the Cleveland Division of Police (CDP) and Cleveland EMS responded to the scene. Amir was transported to a nearby hospital where he was later pronounced deceased.
Further investigation by the CDP revealed Donald Mynatt was the driver of the black Mercedes SUV. He abandoned the SUV, and it was recovered within 24 hours in Cleveland. Mynatt, who was already a wanted fugitive, remained at large until he was located on September 4 by the U.S. Marshals Service’s Northern Ohio Violent Fugitive Task Force. Mynatt was found hiding in an abandoned office space located above storage units in Lake County.
On September 12, 2024, Donald Mynatt was indicted on the following charges:
- Two counts of Failure to Stop After an Accident (second and third-degree felonies)
- One count of Tampering With Evidence
- One count of Negligent Homicide
In order to prove Aggravated Vehicular Homicide beyond a reasonable doubt, the State of Ohio must prove the defendant acted recklessly. At this time, there is no evidence that the defendant was operating the vehicle while under the influence, driving at a high rate of speed, using a cell phone, or engaging in any other conduct that would be considered reckless under the Ohio Revised Code. The investigation remains ongoing.
He will be arraigned at the Cuyahoga County Justice Center at a later date.
